This section describes the Terms and Conditions associated with your use of the torart site and purchases of artwork.
The Process
Ordering a photograph to oil painting from this site by first establishing email contact before purchasing is so the customer and the artist can both interact on the creation process of the painting before it is started and the order is confirmed. When the painting is completed a photograph of the work will be sent to the customer for review and approval.
Prices
The prices listed are for an oil painting mounted on wooden stretcher bars and does not include a picture frame. Picture frames may be ordered upon request at an additional cost. Both insurance and ground shipping to most Canadian and US locations are free but a surcharge may be added for remote locations and/or for the inclusion of an optional picture frame (see Shipping and Insurance section below). The prices listed do not include any customs fees, brokerage fees or applicable taxes. Prices are subject to change without notice.
Purchasing Details for Photo to Oil Painting Orders
When an order is confirmed the artist will send an email invoice to the customer for 50% of the cost of the painting plus applicable taxes that the vendor may be required to collect. All other taxes or duties are the responsibility of the buyer. The down payment is non-refundable once the painting is underway since the artist will have purchased the supplies and materials for the painting and will have started work on creating it. The remaining 50% of the cost of the painting plus any shipping surcharges and/or the addition of a picture frame and taxes the vendor is required to collect will be invoiced once the painting is completed and is ready for shipping. The order cannot be canceled after the second payment is accepted. Once the painting is shipped it can only be refunded or modified at the artist’s discretion and will be subject to additional costs to be paid by the customer.
Shipping and Insurance
Shipping via ground and insurance to most major Canadian and continental US destinations are both free. However, more remote locations in Canada and the US may require a surcharge that, if applicable, will be shown in your final invoice before you authorize payment. Normally, ground shipping requires about 1-7 business days to reach most locations. Express/expedited shipping may be requested at an additional cost. Currently shipping is not available to provinces that have not adopted the HST or that require the vendor to collect the PST. Please contact the artist for costs to destinations other than Canada or the continental US.
Payments
Payments can be made using major credit cards or a PayPal account (a PayPal account is not required for credit card payments) in Canadian or US dollars. Payments by credit card are processed by either PayPal or Square.
Copyright
By sending your photograph to the artist, you indicate that you either own the copyright to the photograph or have permission from the copyright owner to use the photograph.
Using the torart Site and Content
All the content of the torart site is owned by the artist. Any use of the content requires express written consent of the artist. If any of these Terms and Conditions are invalid or unenforceable under applicable law, then it will be, to that extent, considered omitted and the remaining Terms and Conditions will still be in effect.
